Relevant legal bases

The following is an overview of the legal basis of the GDPR on the basis of which we process personal data. Please note that in addition to the provisions of the GDPR, national data protection regulations may apply in your or our country of residence or domicile. If, in addition, more specific legal bases are relevant in individual cases, we will inform you of these in the data protection declaration.

Consent (Art. 6 (1) p. 1 lit. a) DSGVO) - The data subject has given his/her consent to the processing of personal data relating to him/her for a specific purpose or purposes.
Contract performance and pre-contractual requests (Art. 6 (1) p. 1 lit. b) DSGVO) - Processing is necessary for the performance of a contract to which the data subject is a party or for the performance of pre-contractual measures taken at the data subject's request.
Legal obligation (Art. 6 (1) p. 1 lit. c) DSGVO) - Processing is necessary for compliance with a legal obligation to which the controller is subject.
Legitimate interests (Art. 6 (1) p. 1 lit. f) DSGVO) - Processing is necessary to protect the legitimate interests of the controller or a third party, unless such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data.

In addition to the data protection regulations of the General Data Protection Regulation, national regulations on data protection apply in Germany. These include, in particular, the Act on Protection against Misuse of Personal Data in Data Processing (Federal Data Protection Act - BDSG). In particular, the BDSG contains special regulations on the right to information, the right to erasure, the right to object, the processing of special categories of personal data, processing for other purposes and transmission, as well as automated decision-making in individual cases, including profiling. Furthermore, it regulates data processing for employment purposes (Section 26 BDSG), in particular with regard to the establishment, implementation or termination of employment relationships as well as the consent of employees. Furthermore, state data protection laws of the individual federal states may apply.

Security measures

Wir treffen nach Maßgabe der gesetzlichen Vorgaben unter Berücksichtigung des Stands der Technik, der Implementierungskosten und der Art, des Umfangs, der Umstände und der Zwecke der Verarbeitung sowie der unterschiedlichen Eintrittswahrscheinlichkeiten und des Ausmaßes der Bedrohung der Rechte und Freiheiten natürlicher Personen geeignete technische und organisatorische Maßnahmen, um ein dem Risiko angemessenes Schutzniveau zu gewährleisten. Zu den Maßnahmen gehören insbesondere die Sicherung der Vertraulichkeit, Integrität und Verfügbarkeit von Daten durch Kontrolle des physischen und elektronischen Zugangs zu den Daten als auch des sie betreffenden Zugriffs, der Eingabe, der Weitergabe, der Sicherung der Verfügbarkeit und ihrer Trennung. Des Weiteren haben wir Verfahren eingerichtet, die eine Wahrnehmung von Betroffenenrechten, die Löschung von Daten und Reaktionen auf die Gefährdung der Daten gewährleisten. Ferner berücksichtigen wir den Schutz personenbezogener Daten bereits bei der Entwicklung bzw. Auswahl von Hardware, Software sowie Verfahren entsprechend dem Prinzip des Datenschutzes, durch Technikgestaltung und durch datenschutzfreundliche Voreinstellungen. Data processing in third countries

Sofern wir Daten in einem Drittland (d.h., außerhalb der Europäischen Union (EU), des Europäischen Wirtschaftsraums (EWR)) verarbeiten oder die Verarbeitung im Rahmen der Inanspruchnahme von Diensten Dritter oder der Offenlegung bzw. Übermittlung von Daten an andere Personen, Stellen oder Unternehmen stattfindet, erfolgt dies nur im Einklang mit den gesetzlichen Vorgaben. Vorbehaltlich ausdrücklicher Einwilligung oder vertraglich oder gesetzlich erforderlicher Übermittlung verarbeiten oder lassen wir die Daten nur in Drittländern mit einem anerkannten Datenschutzniveau, vertraglichen Verpflichtung durch sogenannte Standardschutzklauseln der EU-Kommission, beim Vorliegen von Zertifizierungen oder verbindlicher internen Datenschutzvorschriften verarbeiten (Art. 44 bis 49 DSGVO, Informationsseite der EU-Kommission: https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection_de).

Data deletion

Die von uns verarbeiteten Daten werden nach Maßgabe der gesetzlichen Vorgaben gelöscht, sobald deren zur Verarbeitung erlaubten Einwilligungen widerrufen werden oder sonstige Erlaubnisse entfallen (z.B. wenn der Zweck der Verarbeitung dieser Daten entfallen ist oder sie für den Zweck nicht erforderlich sind). Sofern die Daten nicht gelöscht werden, weil sie für andere und gesetzlich zulässige Zwecke erforderlich sind, wird deren Verarbeitung auf diese Zwecke beschränkt. D.h., die Daten werden gesperrt und nicht für andere Zwecke verarbeitet. Das gilt z.B. für Daten, die aus handels- oder steuerrechtlichen Gründen aufbewahrt werden müssen oder deren Speicherung zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen oder zum Schutz der Rechte einer anderen natürlichen oder juristischen Person erforderlich ist. Business services

Wir verarbeiten Daten unserer Vertrags- und Geschäftspartner, z.B. Kunden und Interessenten (zusammenfassend bezeichnet als „Vertragspartner“) im Rahmen von vertraglichen und vergleichbaren Rechtsverhältnissen sowie damit verbundenen Maßnahmen und im Rahmen der Kommunikation mit den Vertragspartnern (oder vorvertraglich), z.B., um Anfragen zu beantworten. Wir verarbeiten diese Daten, um unsere vertraglichen Verpflichtungen zu erfüllen. Provision of the online offer and web hosting

Provision of online services on rented storage space: To provide our online services, we use storage space, computing capacity, and software that we rent or otherwise obtain from a corresponding server provider (also known as a "web host"); legal basis: legitimate interests (Art. 6(1)(f) GDPR).
Erhebung von Zugriffsdaten und Logfiles: Der Zugriff auf unser Onlineangebot wird in Form von so genannten „Server-Logfiles“ protokolliert. Zu den Serverlogfiles können die Adresse und Name der abgerufenen Webseiten und Dateien, Datum und Uhrzeit des Abrufs, übertragene Datenmengen, Meldung über erfolgreichen Abruf, Browsertyp nebst Version, das Betriebssystem des Nutzers, Referrer URL (die zuvor besuchte Seite) und im Regelfall IP-Adressen und der anfragende Provider gehören.Die Serverlogfiles können zum einen zu Zwecken der Sicherheit eingesetzt werden, z.B., um eine Überlastung der Server zu vermeiden (insbesondere im Fall von missbräuchlichen Angriffen, sogenannten DDoS-Attacken) und zum anderen, um die Auslastung der Server und ihre Stabilität sicherzustellen; Rechtsgrundlagen: Berechtigte Interessen (Art. 6 Abs. 1 S. 1 lit. f) DSGVO); Löschung von Daten: Logfile-Informationen werden für die Dauer von maximal 30 Tagen gespeichert und danach gelöscht oder anonymisiert. Blogs and publication media

We use blogs or similar means of online communication and publication (hereinafter referred to as "publication medium"). Reader data is only processed for the purposes of the publication medium to the extent necessary for its presentation and communication between authors and readers or for security reasons. Application procedure

Das Bewerbungsverfahren setzt voraus, dass Bewerber uns die für deren Beurteilung und Auswahl erforderlichen Daten mitteilen. Welche Informationen erforderlich sind, ergibt sich aus der Stellenbeschreibung oder im Fall von Onlineformularen aus den dortigen Angaben. Grundsätzlich gehören zu den erforderlichen Angaben, die Informationen zur Person, wie der Name, die Adresse, eine Kontaktmöglichkeit sowie die Nachweise über die für eine Stelle notwendigen Qualifikationen. Complaint to supervisory authority: In accordance with the law and without prejudice to any other administrative or judicial remedy, you also have the right to lodge a complaint with a data protection supervisory authority, in particular a supervisory authority in the Member State where you usually reside, the supervisory authority of your place of work or the place of the alleged infringement, if you consider that the processing of personal data concerning you infringes the GDPR.

Definitions

This section provides you with an overview of the terms used in this privacy policy. Many of the terms are taken from the law and defined primarily in Art. 4 of the GDPR. The legal definitions are binding. The following explanations, on the other hand, are primarily intended to aid understanding. The terms are sorted alphabetically.

Conversion measurement: Conversion measurement (also known as "visit action evaluation") is a method used to determine the effectiveness of marketing measures. To do this, a cookie is usually stored on the user's device within the websites where the marketing measures are carried out and then retrieved again on the target website. This allows us to track whether the ads we place on other websites were successful.
Personal data: "Personal data" means any information relating to an identified or identifiable natural person (hereinafter referred to as "data subject"); A natural person is considered identifiable if they can be identified directly or indirectly, in particular by association with an identifier such as a name, an identification number, location data, an online identifier (e.g., cookie), or one or more special characteristics that express the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
Profiles with user-related information: The processing of "profiles with user-related information," or "profiles" for short, includes any type of automated processing of personal data that consists of using this personal data to analyze, evaluate, or predict certain personal aspects relating to a natural person (depending on the type of profiling, this may include various information regarding demographics, behavior, and interests, such as interaction with websites and their content, etc.). Cookies and web beacons are often used for profiling purposes.
Reach measurement: Reach measurement (also known as web analytics) is used to evaluate the flow of visitors to an online offering and can include visitors' behavior or interests in certain information, such as website content. With the help of reach analysis, website owners can see, for example, at what time visitors visit their website and what content they are interested in. This enables them, for example, to better adapt the content of the website to the needs of their visitors. For the purposes of reach analysis, pseudonymous cookies and web beacons are often used to recognize returning visitors and thus obtain more precise analyses of the use of an online offer.
Remarketing: The terms "remarketing" and "retargeting" refer to the practice of noting which products a user has shown interest in on a website for advertising purposes, in order to remind the user of these products on other websites, e.g., in advertisements.
Location data: Location data is generated when a mobile device (or another device with the technical requirements of location determination) connects to a radio cell, a WLAN or similar technical means and functions of location determination. Location data is used to indicate the geographically determinable position on earth at which the respective device is located. Location data can be used, for example, to display map functions or other information dependent on a location.
Tracking: Tracking refers to the tracking of user behavior across multiple online offerings. As a rule, information about behavior and interests is stored in cookies or on the servers of the providers of tracking technologies (known as profiling) with regard to the online services used. This information can then be used, for example, to display advertisements to users that are likely to match their interests.
Controller: The "controller" is the natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of the processing of personal data.
Processing: "Processing" means any operation or set of operations which is performed on personal data, whether or not by automated means. The term is broad and covers virtually any handling of data, whether it be collection, evaluation, storage, transmission, or deletion.
Target group formation: Target group formation (or "custom audiences") refers to the determination of target groups for advertising purposes, e.g., the display of advertisements. For example, based on a user's interest in certain products or topics on the internet, it can be concluded that this user is interested in advertisements for similar products or the online shop where they viewed the products. The term "lookalike audiences" (or similar target groups) is used when content that is considered suitable is displayed to users whose profiles or interests are presumed to correspond to the users for whom the profiles were created. Cookies and web beacons are generally used for the purpose of creating custom audiences and lookalike audiences.
